Terms of Use
Who Hasn't Paid Last updated: 8 November 2026
These Terms of Use ("Terms") apply to your use of the Who Hasn't Paid mobile app, the website at whohasntpaid.com and related services (the "Service"), provided by WHO HASNT PAID LIMITED, a company registered in England and Wales (company number to be confirmed — incorporation in progress) ("we", "us", "our").
By creating an account or using the Service you agree to these Terms. If you do not agree, please do not use the Service.
1. The Service
Who Hasn't Paid is a group trip planning tool. It lets you create shared itineraries, record who owes what, and send reminders ("nudges") to trip members who haven't paid their share. The Service is a record-keeping and communication tool only.
We do not take, hold, transfer or process payments, and we are not a bank, payment service, debt collector or travel agent. Amounts shown in the app are entered by users. We do not check them and we are not responsible for whether anyone pays.
2. Eligibility and accounts
You must be at least 16 years old (or 13 in the USA, if a higher age does not apply where you live) to use the Service. You must give accurate information, keep your login details secure and tell us if you think your account has been misused. You are responsible for activity on your account.
3. Adding people and sending nudges
Nudges and invitations are sent at the request of users. When you add a person to a trip or ask the app to nudge them: - you confirm that you have that person's permission to share their name, email address and/or phone number with us and for them to receive trip messages and reminders; - you must not add people who have asked not to be contacted, and you must not use the Service to harass, threaten, shame or pressure anyone; - you must not use the Service to collect commercial debts or for marketing; and - you accept that recipients can stop nudges or remove themselves from a trip at any time.
We may limit the number or frequency of nudges, and we may suspend accounts that misuse them.
4. Bookings and affiliate links
The Service contains links to third-party websites and apps, such as Booking.com and other travel partners. Some of these are affiliate links, which means we may earn a commission if you make a booking, at no extra cost to you. Commissions do not affect the price you pay.
Any booking you make is a contract between you and the third party, on that party's terms. We are not a party to that contract and are not responsible for the third party's prices, availability, accuracy of listings, cancellations, refunds, or the quality of any accommodation, travel or other service. Please read the third party's terms and privacy policy before booking. Any information about prices or availability shown in the Service may be out of date.
5. Acceptable use
You must not: - break any law or infringe anyone's rights while using the Service; - upload content that is unlawful, abusive, defamatory, discriminatory or misleading; - send spam or unsolicited messages through the Service; - try to access other users' accounts or data, or interfere with, reverse engineer or overload the Service; or - use automated means to scrape or copy the Service.
6. Your content
You keep ownership of the content you add (such as itineraries and notes). You give us a non-exclusive, worldwide, royalty-free licence to host, store, display and use that content only as needed to run and improve the Service and to show it to the members of your trip. You are responsible for your content.
7. Our intellectual property
The Service, including the name "Who Hasn't Paid", the logo, design, software and text, belongs to us or our licensors. You may use the Service for your own personal, non-commercial purposes only. You must not copy, modify or distribute any part of it without our written permission.
8. Fees
The Service is currently free to use. If we introduce paid features, we will tell you the price and terms before you are charged.
9. Availability and changes
We aim to keep the Service running, but we do not promise it will always be available, uninterrupted or error-free. We may change, suspend or withdraw features at any time. Where a change materially affects you, we will try to give you reasonable notice.
10. Suspension and ending your account
You can delete your account at any time in the app or by emailing info@whohasntpaid.com. We may suspend or close your account if you seriously or repeatedly break these Terms, if we must do so by law, or to protect other users. Sections that by their nature should survive (including 4, 6, 7, 11, 12 and 14) continue after your account ends.
11. Our responsibility to you
If you are a consumer, nothing in these Terms affects your legal rights, including under the Consumer Rights Act 2015. Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded by law.
Subject to that: - we are not responsible for losses that were not foreseeable, for losses caused by third parties (including booking partners and other users), or for any money a trip member fails to pay; - we are not responsible for business losses, as the Service is for personal use; and - because the Service is provided free of charge, our total liability to you in connection with the Service is limited to £100.
12. Disputes between users
Arrangements between trip members, including who owes what, are between those members. We are not responsible for resolving disputes between users, although we may remove content or accounts that break these Terms.
13. Changes to these Terms
We may update these Terms from time to time. We will post the new version with a new "Last updated" date and, if the changes are significant, tell you in the app or by email. If you continue to use the Service after the changes take effect, you accept the new Terms.
14. Governing law and jurisdiction
These Terms are governed by the law of England and Wales. The courts of England and Wales have jurisdiction, except that if you are a consumer living in Scotland or Northern Ireland you may also bring proceedings in your local courts, and if you live in the EU you keep the protection of any mandatory consumer laws of your country and may bring proceedings in your local courts.
